Agreement
By using this website, joining the waitlist, or applying to Migraine Mastery Academy(“the Academy”), you agree to these terms. If you do not agree, please do not use the site.
What the Academy is
The Academy is a professional education and mentorship program for licensed clinicians. It is not a clinical service and does not provide medical advice, diagnosis or treatment. Nothing on this site or in the program creates a physician–patient relationship. Full detail is set out in our educational disclaimer, which forms part of these terms.
The Academy is operated separately from Bashir Neurology and Headache PLLC, Dr. Bashir’s clinical practice in Katy, TX. Applying to or participating in the Academy does not make you or your patients patients of that practice.
Who may participate
The Academy is intended for licensed prescribing clinicians and other appropriately qualified healthcare professionals. By applying, you confirm that the information you provide is accurate and that you hold the professional license or credential you describe.
Applications and enrollment
Joining the waitlist and submitting an application are both expressions of interest. Neither is an offer, and neither creates an enrollment or payment obligation on either side. Cohort dates, format, tuition and any refund terms are confirmed separately in writing before enrollment. No payment is taken through this website.
Your responsibilities as a participant
- You remain the treating clinician for your patients and retain full responsibility for every clinical decision you make.
- You must de-identify any case you bring, and must not disclose protected health information or patient-identifying detail in any session, message or form.
- You are responsible for complying with HIPAA, state privacy and licensure law, and any employer or institutional policy that applies to you.
- You will verify current prescribing information and applicable guidelines before acting on anything discussed.
Program materials and intellectual property
All program materials, session content, frameworks, written resources and this website’s content are owned by Migraine Mastery Academy or its licensors and are provided for your individual professional use. You may not record, reproduce, republish, resell or distribute them, or use them to deliver a competing program, without written permission.
Conduct in sessions
Sessions are professional environments shared with other clinicians. We may remove a participant who behaves abusively, discloses patient-identifying information, records sessions without permission, or otherwise disrupts the program.
Disclaimers
The site and the program are provided on an “as is” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free, and we make no guarantee of any clinical, professional or financial outcome.
Limitation of liability
To the fullest extent permitted by law, Migraine Mastery Academy, Dr. Ferhad Bashir and anyone acting on their behalf will not be liable for any indirect, incidental, consequential or punitive damages, or for any loss arising from clinical decisions made by a participant. Our total liability relating to this site or the program will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section and the one above may not apply to you.
Third-party links
This site links to other websites, including Bashir Neurology and Headache PLLC. We are not responsible for the content or practices of any third-party site.
Changes
We may update these terms as the program develops. Material changes will be reflected in the effective date at the top of this page.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute will be brought exclusively in the state or federal courts located in Harris County, Texas, and you and we each consent to the personal jurisdiction of those courts.
Ending your participation
You may stop using the site or withdraw from the waitlist at any time by emailing us. We may suspend or end access to the site or the program if these terms are breached, if participation risks the confidentiality of case discussion, or if we are required to by law. The sections on intellectual property, disclaimers, limitation of liability and governing law continue to apply after participation ends.
Electronic communications
When you join the waitlist or apply, you agree that we may contact you electronically about the program, and that agreements and notices delivered electronically satisfy any requirement that they be in writing. You can opt out of program emails at any time using the unsubscribe link or by emailing us.
If part of these terms does not hold
If any provision of these terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest will remain in force. A delay in enforcing any part of these terms is not a waiver of it. These terms, together with the privacy policy and the educational disclaimer, are the entire agreement between us about this website and the program.
